    Competition Rules

    These are the terms and conditions (“Rules”) that apply to the “Black Forest Bar Cup 2022 – London Stories” competition (“Competition”). By entering the Competition, each entrant agrees to these Rules and confirms they have read and understood the MEIKO UK Privacy Notice athttps://www.meiko-uk.co.uk/en/data-privacy.

    In particular please see Section 7, which explains the conditions of participation at the Live Event, Section 13, which explains the publicity rights that you grant to us, and section 14, which explains how we limit our liability to you.

    1. Promoter: MEIKO UK Limited, a company incorporated and registered in England and Wales with registered company number 02846559 and registered office address at 393 Edinburgh Avenue, Slough, Berkshire SL1 4UF (“MEIKO”).
    2. Entry period: The Competition opens for entry on 6 May 2022 and closes for entry on 3 June 2022 (“Entry Period”). 
    3. Eligibility: To participate in the Competition, entrants must be a legal resident of Great Britain (England, Scotland and Wales only) or Germany and at least 18 years of age at the time of entry. The following individuals are not eligible: (i) employees or other personnel of MEIKO and any of its group companies or affiliates; (ii) members of the immediate family and/or household (whether related or not) of those individuals; and (iii) anyone else professionally involved or associated with any aspect of the operation or administration of the Competition or the Black Forest Bar Cup. MEIKO reserves the right at any time to require proof of eligibility in such form as MEIKO reasonably considers necessary.
    4. How the Competition works: There are two stages in this Competition. The first stage is a qualifying stage, during which eligible entrants will apply online for one of fifty (50) places to compete in person at a live cocktail-making event in London (“Qualifying Stage”). The second stage is the live event in London, where the fifty (50) selected participants will compete in a live cocktail-making competition for a chance to win one of three (3) available prizes (“Live Event”). A limit of one (1) entry per person applies to this Competition. Multiple entries will be rejected. MEIKO reserves the right to disqualify any person who enters more than once, including where multiple accounts are used.
    5. The Qualifying Stage:
      a.    To enter the Qualifying Stage, eligible entrants must sign up for the Black Forest Bar Cup using the online application form by no later than 3 June 2022. In their application form, entrants must explain in no more than one hundred (100) words why they believe they should be selected for one of the fifty (50) available places in the Live Event, focusing on mixology experience, inspiration and personal motivation. Entrants must also state whether they will require overnight accommodation on the date of the Live Event.
      b.    For Great Britain entrants, the form is available at https://www.meiko-uk.co.uk/en/blackforest2022. For German entrants, the form is available at https://www.meiko.de/de/blackforest2022.
      c.    All applications will be assessed by a panel of experts that will include one (1) independent judge. The judging panel will select the fifty (50) successful participants based on the individual merits of their application. The decisions of the judges are final.
      d.    The fifty (50) successful entrants will be notified of their selection by email on 6 June 2022. The notification will include full details of the Live Event.
      e.    MEIKO will make reasonable efforts to contact the selected participants, but it is each individual’s responsibility to monitor their email account (including any junk mail folders) for receipt of the notification.
    6. The Live Event:
      a.    The Live Event will be held at Juno Rooms, 67-69 Watling Street, London EC4M 9DD on 13 June 2022. The Live Event will start at 5:00 pm and is expected to end at 11:00 pm.
      b.    At the Live Event, each of the fifty (50) participants will be allocated a bar area complete with a selection of ingredients and cocktail-making equipment selected by MEIKO. Participants are not permitted to use their own ingredients or equipment.
      c.    Participants will have fifteen (15) minutes to create a cocktail that best captures how they perceive the essence of the Black Forest region of Germany. 
      d.    Participants will be judged by a panel of experts that will include one (1) independent judge. The panel will judge entries according to the following criteria: (i) relevance to the Black Forest region; (ii) flavour; (iii) presentation; (iv) creativity; and (v) technique. A total of twenty (20) points will be allocated for each category, giving a total of one hundred (100) available points.
      e.    There will be three (3) winners at the Live Event. The winners will be the three (3) highest-scoring participants based on the above judging criteria.
      f.    In the event of a tie for any of the top three (3) positions, the winner of the tie will be the participant who scored highest in the “relevance to the Black Forest region” category. If the scores in this category are tied, the tie will be decided by the independent judge. The decisions of the judges are final. 
      g.    If something beyond MEIKO’s control occurs, which in MEIKO’s sole and absolute discretion makes it unsafe, unlawful, impossible or unfair for participants to continue, MEIKO shall be entitled to discontinue and stop the Live Event and continue it at another time or day in its sole discretion.
      h.    Participation at the Live Event is strictly subject to the conditions of participation set out below.
    7. Conditions of participation at the Live Event:
      a.    All participants are responsible for making their own travel arrangements to attend the Live Event, and for all associated travel and other costs. However, MEIKO will provide reasonable refreshments during the Live Event and, if requested on the initial application form, participants will be provided with overnight accommodation on 13 June 2022. Accommodation will be in a standard single room on a bed-and-breakfast basis at the Hotel Motel London Tower Hill, 24-26 Minories, London EC3N 1BQ. All bookings must be made directly by MEIKO (MEIKO has only limited rooms available)
      b.    Participants must at all times follow the instructions of MEIKO at the Live Event, including in relation to the operation of any equipment provided.
      c.    Participants must at all times behave in a safe and prudent manner for their own safety and the safety of others while participating in the Live Event.
      d.    Participants must not be under the influence of drugs or alcohol at the Live Event.
      e.    Each participant acknowledges that participation at the Live Event involves physical activity and that there is therefore a risk of personal injury and/or property damage. 
      f.    Each participant acknowledges that it is their sole responsibility to determine whether they are sufficiently fit and healthy to participate safely at the Live Event.
      g.    By participating, each participant confirms that they are not suffering from any condition, impairment, disease or infirmity or other illness that would prevent their participation at the Live Event.
      h.    Each participant acknowledges that the Live Event will be photographed and filmed and that photos and video footage featuring them may be used as described in the “Publicity Rights” section below. 
      i.    MEIKO reserves the right to disqualify any participant who breaches the letter or the spirit of any of these conditions of participation and/or these Rules.
    8. Prize: The three (3) winners will each be entitled to receive the following prize package (“Prize”): 
      a.    A ticket for the winner to participate as a competitor in the finals of the “Black Forest Bar Cup 2022” in Offenburg, Germany, in October 2022 (“BFBC Final”);
      b.    Return economy class flights for the winner from a major international airport near the winner’s home to Offenburg, Germany; and
      c.    Two nights’ accommodation for the winner in a standard single room on a bed-and-breakfast basis at a three-star hotel in Offenburg, Germany.    
    9. Prize Conditions: 
      a.    The BFBC Final is operated by Wilfried Schoellmann KG, a private limited company registered in Germany under registration number HRA 700152 and with its registered office at Hauptstraße 88, 77652 Offenburg, Germany. For the avoidance of doubt, MEIKO is not responsible for the organisation or operation of the BFBC Final.
      b.    The Prize package excludes all costs and expenses incurred by the winner that are not expressly set out above, including: (i) any ground transportation and transfers; (ii) any additional food and beverages; (iii) any additional overnight accommodation; (iv) travel and medical insurance, visas and any other required travel documents; (v) any required COVID-19 testing; (vi) any discretionary spending; (vii) tips and gratuities; and (viii) any related taxes.
      c.    The winner is solely responsible for ensuring that they are able to travel at the appointed time on the relevant dates, including for having valid passports and any visas required. No alternative times and dates are available. 
      d.    All flight and hotel bookings must be made by MEIKO. Flight and hotel choices will be at the sole discretion of MEIKO. The winner is solely responsible for making all other travel and other arrangements necessary to use the Prize.
      e.    The winner will be asked for a credit card on check in at the hotel to cover any extras, so they must be able to provide one and cover these costs.
      f.    All elements of the Prize must be used in the same itinerary. The winner is not entitled to receive any unused portion or element of the Prize.
      g.    MEIKO is not responsible for any COVID-19 related travel testing or restrictions applicable to the winner, including, but not limited to any quarantine or isolation-related costs or conditions. The winner is responsible for ensuring that they adhere to all applicable COVID-19 related laws, rules, procedures and protocols.
      h.    MEIKO will have no liability to the winner if the winner is unable to receive the full benefit of the Prize or is denied entry to, or is asked to leave, any venue or event as a result of a failure to abide by these Rules, any applicable venue or event terms and/or any applicable law, or as a result of inappropriate behaviour.
      i.    Unless otherwise stated above, all elements of the Prize are non-transferable, non-refundable, non-exchangeable and no cash alternative is available. However, if MEIKO considers it appropriate, or if it becomes necessary for reasons beyond MEIKO’s control, a Prize may be varied or swapped for a suitable alternative in MEIKO’s discretion.
    10. Winner Notification: The three (3) winners will be confirmed at the Live Event. Notification in writing, with details of how to claim the Prize, will also be sent to each winner within five (5) days of the Live Event using the contact details provided at the time of entry. MEIKO will make reasonable efforts to contact the winners, but it is each winner’s responsibility to monitor their voicemail, email account and other messaging services (including any junk mail folders) for receipt of the notification.
    11. Prize Claims: The winner must claim their Prize by contacting MEIKO with the information requested in the win notification within twenty-one (21) days of receiving their win notification. Travel details and tickets for Prize elements will be sent to the winner as e-tickets by email within sixty (60) days of MEIKO’s receipt of a valid Prize claim. The winner is solely responsible for the safekeeping of their tickets.
    12. Forfeiture and Selection of Alternative Winners: Failure to claim the Prize within the deadline stated above may result in the Prize being forfeited and the selection of an alternative winner. The first alternative winner will be the next highest-scoring participant at the Live Event. Alternative winners will be notified as set out above and must claim their Prize in accordance with the process and deadlines set out above.
    13. Publicity Rights: 
      a.    Each entrant acknowledges that photographs and live video will be captured by or on behalf of MEIKO at the Live Event (“Event Content”) and that such Event Content may feature the entrant’s individual participation at the Live Event. All rights in and to any Event Content shall belong to MEIKO.
      b.    In consideration of the opportunity to participate at the Live Event, each entrant grants to MEIKO and its group companies, affiliates, agents and designees (and each of their successors and assigns) (collectively, the “Licensed Parties”) the right to use (i) Event Content featuring the entrant’s image, likeness, voice, statements and performance (“Contribution”), (ii) the entrant’s name and any relevant biographical information, and (iii) the name and recipe of the entrant’s cocktail creation, for advertising, marketing, promotional, public relations and any other lawful purposes relating to the Competition, in any and all media worldwide, for a period unlimited in time and without further approval, consent or payment.
      c.    Each entrant agrees that their Contribution may be combined with text, music, sound, graphics and other content, and cut, altered, modified, cropped, edited or dubbed into another language without notice.
      d.    Each entrant irrevocably and unconditionally waives, in favour of the Licensed Parties, all moral rights, performers’ rights and similar rights they may have in relation to their Contribution and the name and recipe of their cocktail creation arising under the laws of any jurisdiction.
      e.    For the avoidance of doubt, each entrant agrees that, in the event of a win, MEIKO shall be entitled (but not obliged) to announce the winner’s name, prize and details of their cocktail creation on MEIKO’s websites, social media and other channels. 
      f.    The entrant may also be asked (without further reward) to take part in reasonable publicity connected with the Competition.
    14. Liability:  
      a.    Nothing in these Rules limits or excludes any person’s liability for death or personal injury caused by negligence, for fraud or for any matter for which liability cannot be lawfully limited or excluded.
      b.    Subject to section 14.a above, by entering the Competition, each entrant (on their own behalf and on behalf of their executors, administrators, heirs, next of kin, successors and assigns) hereby releases and forever discharges, and agrees not to threaten or pursue any claim against, MEIKO and its group companies, affiliates, agencies and any entity associated with administering the Competition (collectively, the “Released Parties”) from and against:
      (i)    any and all liability arising from the entrant’s death, disability, personal injury or actions of any kind which may occur during or in connection with the Competition (except to the extent caused by the negligence of the Released Parties); and
      (ii)    any other loss or damage the entrant may suffer or incur as a result of the entrant’s participation in the Competition and/or acceptance, possession, use or misuse of a Prize (or any part).
      c.    In particular, subject to section 14.a above, MEIKO and other Released Parties will not be liable for:
      (i)    any loss or damage caused by a third party who is not acting on behalf of or under the direct instructions of the Released Parties;
      (ii)    any loss or damage occurring as a result of the winner taking up and using any third-party product or service forming part of the Prize (except where caused by the negligence of MEIKO, its agents or distributors or that of their employees);
      (iii)    any loss or damage caused by any event or circumstance beyond the reasonable control of the Released Parties; and
      (iv)    any loss of profits or revenue, loss of anticipated savings or loss of goodwill.
    15. No Endorsement: The Competition is in no way sponsored, endorsed, administered by or associated with any third party. All third-party trademarks and other intellectual property rights are hereby acknowledged. By participating in the Competition, entrants are providing their information to MEIKO, not to any third party. To the maximum extent permitted by applicable law, no third party shall have any liability to any entrant in connection with or arising out of the Competition howsoever caused, including for any costs, expenses, damages and other liabilities.
    16. Cancellation and Variation: MEIKO reserves the right to vary, suspend or cancel the Competition and/or these Rules if it considers it necessary or appropriate to do so, including if there is any actual or anticipated breach of applicable law or if variation, suspension or cancellation is necessary due to an event outside MEIKO’s reasonable control. In the event of cancellation, Prizes may be awarded to winners drawn from entries received prior to cancellation. 
    17. Disqualification: Without limiting the options available to MEIKO, MEIKO reserves the right at any time to disqualify any entries or entrants that MEIKO regards as being in breach of these Rules, any applicable laws, any terms and conditions referred to in these Rules or the spirit of the Competition. In particular, MEIKO reserves the right to disqualify any entrant who, in MEIKO’s reasonable opinion: (i) is not eligible or otherwise competent to participate in the Competition; (ii) fails to comply fully with the health and safety instructions and requirements applicable to the Competition; or (iii) otherwise poses a risk to the health and safety of themselves and/or others. 
    18. Interference with the Competition: Any attempt to damage or undermine the content or legitimate operation of the Competition is prohibited and may also be a violation of criminal and/or civil laws. MEIKO reserves all its rights and remedies to deal with breaches or suspected breaches of this section including, without limitation, to exclude any entrant or winner believed to be associated with such activity.
    19. Disclosure of Winner Details: By entering the Competition, each entrant acknowledges that in the event of a win their surname and county of residence may be disclosed to persons enquiring, where permitted by law. Any entrant may object to their information being made available in this way or may request that the amount of information made available be reduced, by contacting MEIKO using the contact details at the end of these Rules. In these circumstances, the entrant acknowledges that MEIKO may nevertheless disclose the relevant information, and the entrant’s entry, to the UK’s Advertising Standards Authority (and/or any other competent authority) if required to do so. This may happen where MEIKO is required to demonstrate that it has awarded the prizes advertised. To request disclosure of winner details, enquirers must submit a request to bfbc@meiko-global.com no later than two (2) months after the end of the Entry Period. Details will only be disclosed (if permitted by law) after the Prizes have been awarded. 
    20. Accessing these Rules: Any website on which these Rules are posted is only intended to be accessed from Great Britain and Germany and where permitted by law. MEIKO makes no representation that materials relating to the Competition are appropriate or available for use at other locations. Access to them from territories where their contents are illegal is strictly prohibited.
    21. Severance and waiver: If any provision of these Rules is or becomes invalid, illegal or unenforceable for any reason, the validity, legality and enforceability of that provision will not affect the remaining provisions of these Rules, which will remain in full force and effect. MEIKO’s failure to enforce any provision of these Rules will not constitute a waiver of that provision.
    22. Disputes: Subject to the “Law and Jurisdiction” section below, if there is a dispute about the Competition or these Rules, MEIKO’s decisions are final. If there is a dispute between these Rules and any other document referred to in these Rules, these Rules take precedence to the extent necessary to resolve the conflict.
    23. Law and jurisdiction: The laws of England and Wales will apply to these Rules and the Competition, although if the entrant is resident elsewhere in Great Britain or in Germany the entrant will retain the benefit of any mandatory protections given to the entrant by the laws of that part of Great Britain or Germany. The courts of England and Wales will have exclusive jurisdiction over any claim relating to these Rules and the Competition, except that residents of Scotland and Germany may bring a claim in their local courts.
    24. Personal data: Entrants acknowledge that any personal data of entrants processed in connection with the Competition will be processed in accordance with MEIKO’s Privacy Notice, which is available at https://www.meiko-uk.co.uk/en/data-privacy. Entrants acknowledge that MEIKO will need to share personal data with the relevant hotels and, if applicable, with the airline and organiser of the BFBC Final and that such third parties will process the personal data of the entrant as independent data controllers in accordance with their own privacy notices.
